Goodness of Green (“G.O.G.”, “we”, “us”, “our”) operates the website [https://goodnessofgreen.in] and related services (the “Site” and, together with our ecommerce, content, communications, and customer support, the “Services”). By accessing or using the Services, you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, please do not use the Services.

These Terms are governed by the laws of India, including the Information Technology Act, 2000 (and rules thereunder) and the Consumer Protection Act, 2019, as applicable.

1) Eligibility & Account

  • You must be 18+ years and legally competent to contract under the Indian Contract Act, 1872.
  • You are responsible for maintaining the confidentiality of your account credentials and all activities under your account. Notify us immediately of any unauthorized use.

2) Personal Use; No Resale

All purchases are for personal, non-commercial use. Resale (including via marketplaces such as Amazon, Flipkart, eBay, Etsy, etc.) without our prior written consent is prohibited. We may refuse, limit, or cancel any order that appears to be placed by resellers/distributors.

3) Product Information & Health Disclaimer

  • We strive for accuracy in product descriptions, pricing, availability, and images, but do not warrant that information is error-free or exhaustive.
  • Health disclaimer: Our nutraceuticals/food supplements are not intended to diagnose, treat, cure, or prevent any disease. Results vary by individual. Consult a qualified healthcare professional before use—especially if pregnant/nursing, taking medication, or having a medical condition.
  • Where applicable, products are marketed in accordance with FSSAI norms and labelling standards.

4) Orders, Pricing, and Payment

  • Placing an order is an offer to buy; order confirmation (email/SMS) acknowledges receipt, not acceptance. We accept your order when we dispatch the product(s).
  • We may correct pricing/availability errors and cancel orders (with full refund, if charged).
  • Prices include/exclude taxes as stated at checkout. Taxes, shipping, and fees will be shown prior to payment.
  • Payments are processed by our partners Razorpay. We do not store full card details.
  • You agree to provide accurate billing/shipping information and authorize us to charge the selected payment method.

5) Shipping, Risk, and Title

  • Dispatch timelines shown at checkout are estimates. Delays may occur due to courier capacity, strikes, weather, or force majeure.
  • Risk of loss passes to you upon delivery at the address you provide. Title passes upon full payment and dispatch.

6) Return & Refund Policy

We want you to be satisfied. Please read this carefully—it applies to all purchases made on/through our Services.

6.1 Return Window & Condition

  • You must notify us within 30 (thirty) days of delivery to initiate a return.
  • Only unopened, unused bottles in their original condition and packaging (including seals, labels, freebies, and outer cartons) are eligible.
  • Opened, used, tampered, or damaged items (not due to transit damage reported on delivery) are not eligible.

6.2 Non-returnable Items

  • Items marked “final sale”, freebies, samples, and promotional items;
  • Bulk/wholesale orders;
  • Items damaged due to misuse, improper storage, or negligence;
  • Returns raised beyond 30 days from delivery.

6.3 How to Initiate

  1. Email hello@goodnessofgreen.com with Order ID, product name(s), quantity, and reason; attach clear photos (unopened seal, outer box).
  2. Our team will review and, if eligible, issue Return Authorization (RA) and instructions. Do not ship items without an RA.

6.4 Return Shipping

  • For change-of-mind returns, you bear return courier costs and liability until delivered to our designated address.
  • For wrong item/shortage/damaged-in-transit cases reported within 48 hours of delivery (with unboxing photos/videos and outer box photos), we will arrange/cover return pickup or offer a prepaid label.

6.5 Inspection & Refunds

  • After receipt and quality check (3–5 business days), approved refunds are issued to the original payment method within 5–10 business days (bank/card timelines may vary).
  • Shipping fees, COD fees, and payment gateway charges are non-refundable unless the return is due to our error.
  • If any item fails QC (opened/used/tampered), we will notify you. You may request reshipment to you at your cost within 7 days; unclaimed items may be disposed.

6.6 Exchanges

  • Direct exchanges are not offered. Return as above and place a new order.

6.7 Wrong/Defective Items

  • Report within 48 hours of delivery with photos/videos. If verified, we’ll replace or refund (at our discretion) per the above process.

This policy does not limit any statutory rights under the Consumer Protection Act, 2019.

7) Promotions, Coupons, and Gift Cards

  • Offers/coupons are time-bound, non-transferable, and subject to terms on the offer page.
  • Only one code per order unless expressly stated.
  • We may void, modify, or withdraw promotions in case of misuse or technical issues.

8) Intellectual Property

All content on the Services—text, graphics, logos, icons, images, audio/video clips, downloads, data compilations, software, and the G.O.G name and logos—is the property of G.O.G or its licensors and protected under applicable IP laws. No license is granted except as necessary to access and use the Services for personal, non-commercial purposes. You may not copy, modify, reverse engineer, distribute, or create derivative works without written permission.

9) User Content & Reviews

By submitting reviews, testimonials, photos, videos, or other materials (“User Content”), you:

  • represent you own or control the rights in the User Content;
  • grant G.O.G a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, copy, adapt, publish, translate, create derivative works, distribute, display, and exploit such content in any media for any lawful purpose; and
  • waive any moral rights to the extent permitted by law.
    We may moderate or remove content that is unlawful, infringing, misleading, obscene, defamatory, or otherwise objectionable.

10) Acceptable Use

You agree not to: (a) violate law or third-party rights; (b) upload malware or attempt to gain unauthorized access; (c) scrape/harvest data; (d) interfere with security or operation of the Services; (e) submit false, misleading, or harmful content; or (f) use the Services for fraudulent or abusive purposes. We may suspend or terminate access for violations.

11) Third-Party Services & Links

The Services may contain links to third-party sites, tools, payment gateways, analytics, and advertising partners. Their terms and privacy policies govern your use of those services; we are not responsible for their content, availability, or practices.

12) Warranties; Medical/Professional Advice

The Services and all products are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Information on the Site is informational only and not medical advice. Always consult a qualified healthcare professional.

13) Limitation of Liability

To the fullest extent permitted by law:

  • G.O.G (and its directors, officers, employees, agents, affiliates, and suppliers) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits/revenue/data, arising from or related to the Services or products.
  • Our aggregate liability for any claims shall not exceed the amount you paid for the product(s) giving rise to the claim.

Certain rights and remedies may be available under Indian consumer law that cannot be excluded; in such cases, our liability is limited to the extent permitted.

14) Indemnity

You agree to indemnify and hold harmless G.O.G and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your: (a) breach of these Terms; (b) violation of law or third-party rights; or (c) misuse of the Services.

15) Dispute Resolution; Arbitration

  • Good-faith resolution: Contact hello@goodnessofgreen.com; we aim to resolve within a reasonable period.
  • Arbitration: Any dispute arising out of or in connection with these Terms, the Services, or product purchases shall be finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.

    • Language: English
    • Tribunal: Sole arbitrator appointed per the applicable rules.
  • Courts: Subject to arbitration, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction.
  • Injunctive Relief: Either party may seek interim/injunctive relief from competent courts to protect rights pending arbitration.

(Class/representative actions are generally not applicable under Indian procedure; disputes will be addressed individually between you and G.O.G.)

16) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics, war, strikes, governmental actions, internet/courier outages, or supply chain disruptions.

17) Changes to the Services and Terms

We may modify or discontinue the Services (or any part) without notice. We may update these Terms by posting a new version with a revised “Last Updated” date. Your continued use after changes constitutes acceptance.

18) Severability; Assignment; Waiver

If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder remains in effect. You may not assign your rights/obligations without our consent; we may assign to an affiliate or successor. Our failure to enforce a provision is not a waiver.
